Judge rules against Alameda parents who sought opt-out from ‘anti-bullying’ classes, three school board members targeted for recall

Fresh from a victory in court, the Alameda School Board is scheduled tomorrow to further expand district programs that teach students what some parents consider pro-homosexual propaganda. Last week, a superior court judge ruled that parents cannot use provisions in state law to opt their children out of such lessons. (Look for a surge in homeschooling, unless THAT is considered illegal by some activist judge!)

On Dec. 2, Alameda Superior Court Judge Frank Roesch ruled that the school district's “anti-bullying” curriculum does not constitute “health education,” so parents could not use provisions in state law that allow parents to keep their students out of such classes.

“The Lesson 9 curriculum has a distinct and focused purpose tied to preventing discrimination against young students based on the LGBT structures of their families, and any overlap with the Health Ed Content Standards is not significant and does not support Petitioners’ claimed right to opt out of instruction for their children in the Lesson 9 curriculum,” the judge said in his ruling.

Pacific Justice Institute, which represented parents who wanted to keep their children out of the classes, said Judge Roesch “lambasted the parents, repeatedly insinuating that they are bigots and insisting there can be no homosexual indoctrination because people are born that way. (Which has no scientific basis, even the scientist who originally proposed the idea of a "gay gene" has gone on record as saying he was wrong.) The judge equated a view contrary to his own with creationism and called both false.” (So he's a religious expert also? California judges sure are versatile.)

In addition, said Pacific Justice Institute, “attorneys for the school district grilled parents in depositions about their religious beliefs. Parents were asked numerous questions about church attendance, sermons they had heard against homosexuality, and whether they were aware that the Bible had been used to defend racism and oppression.” (All of which has no bearing whatsoever on the issue at hand. It's guilt by association and notice how religion in general is thrown into that.)

“We believe that this ruling against parents is inconsistent with the Education Code, and we are looking forward to continuing this battle until opt-out rights are restored on appeal, or the curriculum is changed,” said Pacific Justice Institute chief counsel Kevin Snider in a prepared statement. Snider said the parents he represents oppose the “anti-bullying” classes in elementary schools because the curriculum “focuses almost exclusively on homosexuality.” (Big surprise.)

According to Pacific Justice Institute, “School records released by Alameda Unified School District show that bullying based on race and gender is far more prevalent in AUSD than sexual orientation harassment.”

“Most parents do not want their first through fifth graders bombarded with pro-homosexual messages at school,” said President Brad Dacus, president of Pacific Justice Institute. “If LGBT advocates really want to stop name-calling and bullying, they should start with themselves.” (Amen)

The school board approved the lessons by a 3-2 vote on May 26. Since then, a group of parents has launched a drive to recall the three board members who voted in favor of the curriculum -- Tracy Jensen, Ron Mooney and Niel Tam.

“We have teams currently working hard towards getting the necessary signatures to qualify for the ballot,” Kellie Wood, a leader of the recall drive, told California Catholic Daily in an email. The recall group calls itself ‘S.E.R.V.E. ALAMEDA.’

Tomorrow, the school board will consider expanding the controversial curriculum for students in grades 3 to 5. The meeting will begin at 7:30 p.m. in the city council chambers at Alameda City Hall, 2263 Santa Clara Avenue. (What the hell do children of that age group need to know regarding "bullying" of gay? Seems like it's a case of indoctrinating them as young as possible.)

Alameda School Superintendent Kirsten Vital defended the school district’s policy and praised the judge’s decision. “The District believes that preventing and addressing bullying and harassment is key to creating safe and welcoming schools that are conducive to learning,” Vital said in a press release. “This ruling affirms our ability to help ensure our schools are safe learning environments where everyone is accepted and welcomed.” (Yep. A good advertisement for home schooling.)
