Conscience protection laws going away

Washington D.C., Feb 18, 2011 / 08:23 pm (CNA/EWTN News).- President Obama's Secretary for Health and Human Services, Kathleen Sebelius, issued new regulations on Feb. 17, canceling out numerous conscience protections for health care workers who have moral or religious objections to certain procedures.

The new rules claim to leave in place the protections for health care providers who oppose abortion and sterilization. However, they remove many other protections for caregivers, including those who are morally opposed to providing services such as in vitro fertilization, contraception – including chemical contraceptives that can cause an abortion – and facilitating sexual practices they consider wrong.

In her report describing the changes, Sebelius criticizes the Bush-era regulations, which clarified the rights of many conscientious objectors to opt of procedures, as “unclear and potentially overly broad in scope.”

Sebelius acknowledged in the final report that “a substantial number of comments in opposition to rescinding the 2008 Final Rule maintained that Roman Catholic hospitals would have to close, that rescission of the rule would limit access to pro-life counseling, and that providers would either leave the health care industry or choose not to enter it.”

The secretary is a professed Catholic herself, although her local ordinary Archbishop Joseph Naumann advised her not to receive Holy Communion in the Church, due to her strong and continued support of abortion.

In her Feb. 17 report, Sebelius sought to respond to Catholic health workers' concerns by noting that “under this partial rescission of the 2008 Final Rule, Roman Catholic hospitals will still have the same statutory protections afforded to them as have been for decades.”

However, it was precisely in order to solidify those decades-old “statutory protections” in significant ways, that the 2008 rule was made in the first place.

“The Department supports the longstanding federal health care provider conscience laws,” the secretary continued, “and with this Final Rule provides a clear process to enforce those laws.”

The purpose of the 2008 rule, however, was not simply to reiterate the content of existing laws, but to clarify how they should be applied, and to provide explicitly for their enforcement.

For this reason, the United States Conference of Catholic Bishops had praised the previous rule as a “much-needed implementation of long-standing laws” – saying it clarified many “undefined terms” that allowed state and local governments to “attack conscience rights as though they do not exist.”

With those “much-needed” rules and clarifications gone, Catholic hospitals and health care workers may find themselves facing difficult situations without explicit protections.

Sebelius pointed out that her department would still be willing to receive and consider their complaints.

The portion of the 2008 rule that enables the Office for Civil Rights to investigate complaints from conscientious medical objectors is “being retained,” she said.

“Under this Final Rule,” she offered, “health care providers who believe their rights were violated will now be able to file a complaint with the Department’s Office for Civil Rights in order to seek enforcement of those rights.”

Dr. J. Scott Ries, a board-certified family physician and a vice president of ministry at the 16,000-member Christian Medical Association, said the rule change touched on areas of “critical concern for pro-life patients, healthcare professionals and institutions.”

“The administration has made changes in a vital civil rights regulation without evidence or justification,” Dr. Ries said. He criticized the regulatory action as a move that “diminishes the civil rights that protect conscientious physicians and other healthcare professionals against discrimination.”

Watch for the lawsuits to come in against Catholic hospitals. It'll be "death by a thousand cuts" as these institutions successfully defend themselves in the courts while being bled dry due to the financial costs.

They'll then find themselves with the choice of closing or caving in to prevent further legal actions they'd have to fight. This is where the Church will be further divided as some hospitals will choose to stay open and serve Moloch while providing medical care for the genuinely sick. The other facilities that choose to close will be roundly condemned as heartlessly adhering to misogynistic standards of a less enlightened time.

We'll see a continued push against the ones faithful to Church teaching, having those less loyal held up to them and the general public as examples of reason and moderation.

Thus the marginalization/persecution will begin in earnest.

The cleverness of this move by the evil minions of Moloch are diabolical. With the removal of explicit protection against being required to dispense, contraceptives, fit diaphragms etc.,many people will be forced to chose between their faith, and their ability to support their families. Some will leave their profession, others will compromise,driving a wedge between them and their faith.

Worse still--people of faith will begin to avoid the Health Professions, leading to an ever accelerating secularization of health care--with it's consequence of euthanasia, sterilizations, and the whole death worship wrap following. Really, this started in the early 70s--when federal regs put the religiously affiliated 3 year nursing school largely out of business, and turned the profession over to the universities and state community colleges.

These consequences are probably not intended by the people who write these regs--but they sure as hell are by the demons who inspire them.

That's what I don't understand. How many alleged Catholics like Sibelius and Pelosi get away with supporting the murder of our unborn and still pull a huge number of Catholic votes? Advise not to take Communion? Isn't there someway/someone in the church hierarchy to kick them out of the church! What if they take Communion does it count? I don't understand.

Harry, the sad part about it is that I know you're joking but it's also a statement of coming reality. If BO won't wind up being our conscience and tell us when/when not to have scruples, then it'll be someone just like him.

Pops, I know a lot of other denominations will make a public fuss over excommunicating someone. A fair number of Catholic bishops will also publicly denounce and ban anyone flouting Church teaching (Arbp. Chaput comes to mind as a good example).

But too many of our bishops lack a spine when it comes to confronting public figures such as Pelosi, Biden, etc. The bishops will claim they're doing all they can but thats pure hogwash.

As far as excommunication goes, by publicly supporting abortion these pols have automatically done that. They know as well as anyone yet it makes zippo difference to them. They're more concerned with the affairs of this world than anything else.

Since the spineless bishops I mentioned refuse to act, the average pewsitter sees all this and feels they also can flout Church teaching. Which they successfully do. Which further weakens the Church and by extension anyone who might be in sympathy with those ignored teachings.

A couple of comments above yours the Ignorant Redneck mentioned demonic inspiration. Call me crazy but I believe thats the literal truth. As you know, the Enemy is active in all churches now, not just the Catholic one.

Where does it all end? Heck if I know but I recall a story about a bunch of clerics in Auschwitz. It seems they were the usual gang of Christians, Catholics, Lutherans, etc. when they had a new addition who was Pentecostal. Feeling a bit out of place, the minister identified his religious affiliation. A Lutheran bishop dryly observed, "In here we're all Pentecostal son."
