relating to prohibiting human cloning; providing a penalty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Subtitle H, Title 2, Health and Safety Code, is amended by adding Chapter 174 to read as follows:
CHAPTER 174. USE OF HUMAN CELLS AND TISSUE
Sec. 174.001. HUMAN REPRODUCTIVE CLONING. (a) A person commits an offense if the person places in a woman's womb a human embryo created by a method other than fertilization.
(b) An offense under this section is a felony of the first degree.
SECTION 2. This Act takes effect September 1, 2009.
